Inspector, three others acquitted of detainee’s murder

KUALA LUMPUR: The High Court today acquitted and discharged a police inspector and his three subordinates for the murder of detainee N. Dharmendran, three years ago.

Judge Datuk Kamardin Hashim in acquitting the men, said the prosecution failed to prove a case beyond reasonable doubt against the four accused.

Inspector S. Hare Krishnan, 42, Sergeant Jaffri Jaafar , 46, Corporal Mohd Nahar Abd Rahman, 47, and Corporal Haswadi Zamri Sahari, 34, wept and hugged family members and friends, after the verdict was read.

The men were charged with committing the offence at the D9 investigation office, 7th Floor, Kuala Lumpur Police Contingent headquarters, Jalan Hang Tuah here between 12.20pm and 2.50pm between May 18 and May 21, 2013.

The four accused were initially acquitted by the Kuala Lumpur High Court without their defence being called on Dec 12, 2014.

However the Court of Appeal ruled that there was overwhelming evidence that the four respondents were responsible for Dharmendran when he died under their custody.

The Apex Court also ordered them be remanded until disposal of the murder case and ordered the trial to resume at the Kuala Lumpur High Court. Prosecution was conducted by senior deputy public prosecutor Suhaimi Ibrahim.

Counsels M. Athimulan and Gobind Singh Deo acted for Hare Krishnan while Jaffri, Nahar and Haswadi were represented by counsel Datuk Baljit Singh Sidhu and Hisyam Teh Poh Teik.-nst
