PKR’s Surendran seeking to strike out sedition charge

KUALA LUMPUR: PKR vice-president N. Surendran seeks to strike out one of his sedition charges on grounds that it is interfering in his duty as lawyer to ex-opposition leader Datuk Seri Anwar Ibrahim.

Padang Serai member of parliament Surendran, via his lawyer Latheefa Koya, filed the Notice of Motion at the High Court Registry here this morning.

Surendran, 50, is targeting the charge that accused him of making seditious remarks at the Palace of Justice, Putrajaya, between 2pm and 4pm, on Aug 8, 2014.

The remarks, which pertained to Anwar’s then-ongoing appeal in his second sodomy case, was purportedly recorded on a video later uploaded to YouTube.

According to court papers made available to the media, Surendran claimed that the sedition charge was made in bad faith and jeopardised the supremacy of the law and criminal legal process.

He alleged that his related prosecution violated his duties and responsibilities as a lawyer under the Legal Profession Act 1976 and the United Nations Basic Principles on the Role of Lawyers, among others.

Surendran also claimed that no reasonable Public Prosecutor would have allowed the said sedition charge to proceed in court.

His present legal bid does not target his other sedition charge related to his press statement made at the office of online news portal Malaysiakini, at Bangsar Utama here, around 3.40pm on April 18, 2014.

The other sedition case was also in relation to remarks over the sodomy case against 68-year-old Anwar, who is currently serving a five-year jail sentence over the offence. 29 reads
