Bus driver in Menora Tunnel incident fined RM8,000 for careless driving

IPOH: A bus express driver was fined RM8,000 in default eight months’ jail by the Special Traffic Court here Wednesday after changing his plea to guilty for careless and inconsiderate driving.

Kadershah Sabaruddin, 52, admitted committing the offence at about 2.45pm on July 10, 2016 at Km265.8 southbound along the North South Expressway (PLUS).

He paid the fine.

The charge under Section 43(1) of the Road Transport Act 1987 carries a maximum fine of RM10,000 and 12 months’ imprisonment on conviction.

Magistrate Siti Hanum Mohmad Sah allowed prosecuting officer Inspector Mohd Yusoff’s application for the conviction to be recorded in Kadershah’s driving licences.

Jasli told the court that the Computerised Vehicle Inspection Centre (Puspakom) had confirmed that the accident was aggravated by leakage in the actuators chamber of the bus’ rear right brake.

“Investigations revealed that the damage did not occur suddenly but was detected by the accused during the trip from Juru to Penang and he should not have continued the journey,” Jasli submitted.

In mitigation, Kadershah, who was unrepresented, asked for a lower fine saying that he had to support his mother and three children.

It was previously reported that the bus driven by Kadershah rammed into 10 vehicles near the Menora Tunnel on the highway, causing a massive traffic jam from the Kuala Kangsar exit to Jelapang, and from Bukit Gantang to Bukit Berapit. – Bernama
